Welcome to the online travel and trekking booking system of MONS Actividades de Montaña (hereinafter the "Site"). These Terms of Use govern access to and use of the Site by any person who enters it (hereinafter the "User"). Use of the Site implies unconditional acceptance of the conditions set forth herein.
By entering the Site, the User declares that they know and accept these Terms of Use. Modifications to these conditions will be in effect from their publication on the Site, and such publication shall constitute sufficient notice.
The site is intended for the promotion and booking of adventure tourism treks, dissemination of knowledge and expertise in physical training and life in nature. These services may be used by persons of legal age with legal capacity to contract who accept these Terms of Use.
Persons without legal capacity and minors may not use the site. Anyone who registers as a User on behalf of a legal entity must have the capacity to contract on behalf of such entity.
The User declares that the information provided when submitting the booking request will be accurate, correct and current, and shall be entirely responsible for any damages that failure to comply with this obligation may cause. Providing inaccurate or false information constitutes a serious violation of these Terms of Use.
Making a booking implies the User's express acceptance of these Terms of Use, entering into a deposit contract with MONS Actividades de Montaña.
The User enters the site and chooses the expedition of interest. They may request additional information or reserve a place by means of a deposit. Through the BOOK button, the site redirects the User to the PayPal or Mercado Pago platform to make the payment.
Once the data form is completed and the deposit is paid, a confirmation email will be sent along with the Medical Form, which must be completed and submitted to MONS Actividades de Montaña. Final confirmation of the booking will be subject to compliance with all participation conditions.
After a booking is approved by the User, MONS Actividades de Montaña may not be able to accept it for various reasons: lack of authorization from the card-issuing entity, inaccuracies in the information, issues identified by the fraud prevention area, or when the User is not in physical or health condition to undertake the requested expedition.
MONS Actividades de Montaña reserves the right to cancel any transaction after verification of the data entered, communicating the decision to the user in all cases.
The Site uses the services of PayPal Pte. Ltd., Mercado Pago, PayWay, GetNet, WeTravel. The conditions established by these companies depend exclusively on them. MONS Actividades de Montaña reserves the right to include, exclude or suspend any payment method.
Information on expeditions and prices is subject to change without prior notice, with publication on the site constituting sufficient notice. All prices expressed include VAT, unless otherwise indicated.
The User agrees not to access the Site by means other than the interface provided by MONS Actividades de Montaña, and not to perform activities that interfere with its normal operation. It is prohibited to compromise the security of the site, access unauthorized data, or use automated devices to browse or extract information.
Violations of system security may result in civil or criminal liability. Creating deep links or "framing" any part of the site without prior written authorization is prohibited.
MONS Actividades de Montaña has implemented the processes required for the protection of Users' personal data, in order to prevent misuse, alteration, unauthorized access or theft.
The holder of the personal data has the right to exercise the right of access to such data free of charge at intervals of not less than six months, as established in Article 14, paragraph 3 of Law No. 25.326. They may rectify their data or request their removal from the database at any time.
This contract is governed by the legislation in force in the Argentine Republic. Any conflict shall be resolved by the competent ordinary courts. In the event that the legislation does not define specific jurisdiction, the national ordinary courts in commercial matters with seat in the City of Río Cuarto, Province of Córdoba shall have jurisdiction.
